On October 17, 2006 after reading the record and briefs that clearly show that the Secratary of State has no basis and no evidence to designate Kahane Chai as a terrorist organization the court desided not to reverse the designation. Here are a few choice quotes from that decision:

• We make no judgment as to the accuracy of the information in the (government's) record.
  
  
• We do not invalidate a designation simply because it is logically possible that the secretary’s conclusion might be wrong
